Angielska 3<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">\u00a7 1. Definitions<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Terms used in these Terms and Conditions have the following meanings:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li><strong>Client<\/strong> \u2014 a natural person, legal person or organisational unit without legal personality to which special provisions grant legal capacity, placing an Order in the Shop.<\/li>\n\n\n\n<li><strong>Consumer<\/strong> \u2014 a Customer who is a natural person making a purchase unrelated directly to their business or professional activity (Art. 22\u00b9 of the Civil Code). Provisions relating to a Consumer also apply to a natural person concluding a contract directly related to their business activity when the content of that contract indicates that it is not of a professional nature to them (Art. 385\u2075 of the Civil Code).<\/li>\n\n\n\n<li><strong>Civil Code<\/strong> \u2014 the Act of 23 April 1964 \u2014 Civil Code (consolidated text, Journal of Laws of 2024, item 1061, as amended).<\/li>\n\n\n\n<li><strong>Terms and Conditions<\/strong> \u2014 these terms and conditions governing the provision of electronic services within the bupu.pl online shop.<\/li>\n\n\n\n<li><strong>Online Store (Store)<\/strong> \u2014 the online service available at bupu.pl, through which the Customer may, in particular, place Orders.<\/li>\n\n\n\n<li><strong>Goods<\/strong> \u2014 products presented in the Online Shop, in particular original paintings, graphics, reproductions and other works by the Shop's owner.<\/li>\n\n\n\n<li><strong>Work (Artwork)<\/strong> \u2014 a Good constituting a work within the meaning of the Copyright Act, in particular a painting, graphic or other artistic work.<\/li>\n\n\n\n<li><strong>Sales contract<\/strong> \u2014 a contract for the sale of Goods within the meaning of the Civil Code, concluded between A Design Anna Kawalec and the Customer using the Shop's online service.<\/li>\n\n\n\n<li><strong>Consumer Rights Act<\/strong> \u2014 the Act of 30 May 2014 on Consumer Rights (consolidated text, Journal of Laws of 2023, item 2759, as amended).<\/li>\n\n\n\n<li><strong>Copyright Act<\/strong> \u2014 the Act of 4 February 1994 on Copyright and Related Rights (consolidated text, Journal of Laws of 2022, item 2509, as amended).<\/li>\n\n\n\n<li><strong>Order<\/strong> \u2014 a declaration of intent by the Customer aimed directly at concluding a Sales Contract, specifying in particular the type and quantity of the Goods.<\/li>\n<\/ol>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">\u00a7 2. General provisions<\/h2>\n\n\n\n<ol class=\"wp-block-list\">\n<li>These Terms and Conditions set out the rules for using the online shop available at bupu.pl.<\/li>\n\n\n\n<li>These Terms and Conditions specify in particular:<br>a) the conditions and rules for placing Orders electronically within the Shop,<br>b) the rules for concluding Sales Contracts using the services provided within the Shop,<br>c) the rules concerning copyright to the purchased Artworks.<\/li>\n\n\n\n<li>Use of the Shop is possible provided that the Customer's IT system meets the following minimum technical requirements: internet access, a web browser (including on mobile devices) and an active e-mail account.<\/li>\n\n\n\n<li>To ensure the security of transmitted communications and data, the Shop takes technical and organisational measures appropriate to the level of risk to the security of the services provided, in particular measures to prevent unauthorised persons from obtaining and modifying personal data.<\/li>\n<\/ol>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">\u00a7 3. Nature of Goods<\/h2>\n\n\n\n<ol class=\"wp-block-list\">\n<li>The Goods offered in the Shop are original artworks (paintings, graphics) and their reproductions. Every Good marked as an \"original\" is a unique work existing in a single copy.<\/li>\n\n\n\n<li>The Shop makes every effort to ensure that the photographs and descriptions of the Goods reflect their actual appearance, colours, dimensions and character as accurately as possible. Due to the individual nature of artworks and differences in monitor and display calibration, the actual colours of a Good may differ slightly from those shown on screen. Such differences do not constitute a defect of the Good or grounds for a complaint.<\/li>\n\n\n\n<li>In the case of hand-painted pictures, minor variations in texture, paint application and finish may occur, resulting from the handmade nature of the work. These characteristics attest to the artistic value and uniqueness of the Artwork and do not constitute a defect of the Good.<\/li>\n\n\n\n<li>The dimensions given in the description of a Good may differ from the actual dimensions by \u00b11 cm, which results from the handmade production process.<\/li>\n<\/ol>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">\u00a7 4. Rules for Using the Store<\/h2>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Making a purchase does not require registration (creating an account) in the Shop.<\/li>\n\n\n\n<li>Information about the Goods provided on the Shop's pages, in particular their descriptions, specifications and prices, constitutes an invitation to conclude a contract within the meaning of Art. 71 of the Civil Code and does not constitute an offer.<\/li>\n\n\n\n<li>All prices of Goods shown on the Shop's pages are gross prices (including VAT) and are quoted in Polish zlotys. Prices do not include delivery costs, which are indicated during the ordering process.<\/li>\n\n\n\n<li>Orders are placed using the form available on the Shop's website.<\/li>\n\n\n\n<li>The Shop enables the purchase of Goods 24 hours a day, 7 days a week, subject to technical maintenance breaks.<\/li>\n\n\n\n<li>By placing an Order, the Customer agrees to receive e-mails at the provided address relating to the progress of order fulfilment (order confirmation, dispatch notification, etc.).<\/li>\n<\/ol>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">\u00a7 5. Procedure for concluding a Sales Contract<\/h2>\n\n\n\n<ol class=\"wp-block-list\">\n<li>To conclude a Sales Contract, visit bupu.pl, select the Goods and follow the subsequent technical steps as indicated by the on-screen prompts.<\/li>\n\n\n\n<li>The Customer selects Goods by adding them to the cart.<\/li>\n\n\n\n<li>While placing the Order \u2014 until the \"Buy and pay\" button is pressed \u2014 the Customer may modify the entered data and the selected Goods.<\/li>\n\n\n\n<li>To finalise the Order, the Customer provides the following data:<br>a) first name and surname \/ company name,<br>b) delivery address,<br>c) e-mail address,<br>d) contact phone number,<br>e) tax ID (NIP) \u2014 if a VAT invoice is requested.<\/li>\n\n\n\n<li>Once all required data have been entered, an Order summary will be displayed containing information about:<br>a) the subject of the order,<br>b) the unit and total price of the Goods, including delivery costs and any additional costs (if applicable),<br>c) the chosen payment method,<br>d) the chosen delivery method.<\/li>\n\n\n\n<li>To submit the Order, the Customer must read the Terms and Conditions and the Privacy Policy, confirm this by ticking the appropriate checkbox, provide the data marked as required, and press the \"Buy and pay\" button.<\/li>\n\n\n\n<li>Submitting the Order by the Customer constitutes a declaration of intent to conclude a Sales Contract with A Design Anna Kawalec, in accordance with these Terms and Conditions.<\/li>\n\n\n\n<li>After placing and paying for the Order, the Customer will receive an e-mail entitled \"Order confirmation\" containing confirmation of all essential elements of the Order.<\/li>\n\n\n\n<li>The contract is deemed concluded upon the Customer's receipt of the message referred to in para. 8.<\/li>\n\n\n\n<li>The Sales Contract is concluded in the Polish language, with the content consistent with the Terms and Conditions.<\/li>\n<\/ol>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">\u00a7 6. Delivery<\/h2>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Detailed information about delivery times and costs can be found on the \"Delivery time and cost\" subpage at: bupu.pl\/czas-i-koszt-dostawy\/.<\/li>\n\n\n\n<li>Due to the nature of the Goods (artworks), each parcel is carefully packed to protect against mechanical damage, moisture and soiling (using, among other things, cardboard corner protectors, protective film and rigid packaging).<\/li>\n\n\n\n<li>Upon receipt of the parcel, the Customer should check the condition of the packaging. In the event of visible external damage, it is recommended to draw up a damage report in the presence of the courier and to contact the Shop without delay.<\/li>\n<\/ol>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">\u00a7 7. Payment methods<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Detailed information about available payment methods can be found on the \"Payment methods\" subpage at: bupu.pl\/formy-platnosci\/.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">\u00a7 8. Right of withdrawal<\/h2>\n\n\n\n<ol class=\"wp-block-list\">\n<li>A Customer who is a Consumer has the right to withdraw from a distance contract, without giving a reason, within 14 days of receiving the Goods.<\/li>\n\n\n\n<li>To exercise the right of withdrawal, the Consumer should inform A Design Anna Kawalec of the decision by means of an unambiguous statement sent:\n<ul class=\"wp-block-list\">\n<li>by post to: A Design Anna Kawalec, ul. Angielska 3, 63-500 Ostrzesz\u00f3w, or<\/li>\n\n\n\n<li>by e-mail to: <strong>pufoswiat@gmail.com<\/strong>.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>To meet the deadline it is sufficient to send the statement before it expires. The Consumer may use the model withdrawal form set out in Annex 2 to the Consumer Rights Act, although this is not mandatory.<\/li>\n\n\n\n<li>In the event of withdrawal, the contract shall be deemed not to have been concluded. The Consumer must return the Goods without undue delay, no later than 14 days from the date on which they communicated the withdrawal. The Goods should be returned to: A Design Anna Kawalec, ul. Angielska 3, 63-500 Ostrzesz\u00f3w.<\/li>\n\n\n\n<li>The returned Good should be packed in a way that prevents damage during transit. Due to the nature of the Goods (artworks), we ask for particular care: use rigid packaging, protective film and cardboard corner protectors. The Shop is not liable for damage to the Good caused during transit due to improper packaging by the Customer.<\/li>\n\n\n\n<li>In the event of withdrawal, the Shop will refund all payments received from the Consumer, including the cost of delivering the Goods (except for any additional costs arising from a delivery method chosen by the Consumer other than the least expensive standard delivery method offered by the Shop), without undue delay and no later than 14 days from the date of receipt of the returned Good. The refund will be made using the same means of payment as used in the original transaction, unless the Consumer has expressly agreed to a different method.<\/li>\n\n\n\n<li>The Consumer bears the direct costs of returning the Goods.<\/li>\n\n\n\n<li>The Consumer is liable for any diminished value of the Goods resulting from handling them beyond what is necessary to establish their nature, characteristics and functioning. In the case of Artworks, this means the Consumer may unpack and inspect the Good but should not hang it on a wall, display it or otherwise use it. Traces of mounting, soiling, damage to the painted surface or the frame constitute a diminished value of the Good.<\/li>\n\n\n\n<li><strong>The right of withdrawal does not apply to the Consumer<\/strong> in respect of Goods manufactured to the Consumer's specifications or serving to satisfy the Consumer's individualised needs (Art. 38(3) of the Consumer Rights Act), in particular paintings and graphics made to the Customer's individual order (e.g. a painting in a non-standard size, colour scheme or subject chosen by the Customer). The Customer will be informed of the absence of the right of withdrawal before placing the Order.<\/li>\n<\/ol>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">\u00a7 9. Complaints<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Detailed information about the complaint and return procedure can be found on the \"Returns and complaints\" subpage at: bupu.pl\/zwroty\/.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">\u00a7 10. Out-of-court complaint and redress procedures<\/h2>\n\n\n\n<ol class=\"wp-block-list\">\n<li>The Consumer has the option of using out-of-court complaint and redress procedures, in particular:<br>a) applying to the permanent consumer arbitration court attached to the regional trade-inspection authorities for dispute resolution,<br>b) applying to the regional trade inspector to initiate mediation proceedings,<br>c) seeking assistance from the district (municipal) consumer ombudsman or a social organisation whose statutory tasks include consumer protection.<\/li>\n\n\n\n<li>Detailed information about out-of-court complaint and redress procedures is available on the website of the Office of Competition and Consumer Protection: <a href=\"https:\/\/www.uokik.gov.pl\">https:\/\/www.uokik.gov.pl<\/a>.<\/li>\n\n\n\n<li>Pursuant to Regulation (EU) No 524\/2013 of the European Parliament and of the Council of 21 May 2013, the Consumer has the right to use the ODR (Online Dispute Resolution) platform available at: <a href=\"https:\/\/ec.europa.eu\/consumers\/odr\/\">https:\/\/ec.europa.eu\/consumers\/odr\/<\/a> for electronic dispute resolution.<\/li>\n<\/ol>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">\u00a7 11. Copyright and intellectual property<\/h2>\n\n\n\n<ol class=\"wp-block-list\">\n<li>All Goods offered in the Shop constitute works within the meaning of the Copyright Act and are protected by copyright.<\/li>\n\n\n\n<li><strong>Purchasing a Good means acquiring ownership of the physical copy (carrier) of the Artwork. The purchase does not entail the transfer of economic copyright or the granting of a licence to use the Artwork in any way beyond the permitted personal use<\/strong> as defined in Art. 23 of the Copyright Act.<\/li>\n\n\n\n<li>In particular, without the separate, written consent of the Author, the Customer may not: <strong>is not entitled<\/strong> to:<br>a) reproduce (copy) the Artwork for commercial purposes,<br>b) make the Artwork publicly available on the Internet in a resolution that allows reproduction,<br>c) use the Artwork or parts thereof for advertising, commercial or marketing purposes,<br>d) create derivative works (adaptations, modifications) based on the Artwork for commercial purposes,<br>e) resell reproductions (copies) of the Artwork.<\/li>\n\n\n\n<li>The Customer has the right to resell the purchased original copy of the Artwork (exhaustion of rights \u2014 Art. 51(3) of the Copyright Act).<\/li>\n\n\n\n<li>The Customer has the right to share photographs of the purchased Artwork on social media as part of permitted personal use (e.g. a photo of an interior featuring the painting), provided that authorship is credited (e.g. by tagging @bupu.pl).<\/li>\n\n\n\n<li>All content published in the Shop \u2014 including product photographs, descriptions, texts, logos and website layout \u2014 is the property of A Design Anna Kawalec and is legally protected. Any use without consent is prohibited.<\/li>\n\n\n\n<li>The transfer of economic copyright or the granting of a licence to use the Artwork is possible only on the basis of a separate, written agreement with the Author.<\/li>\n<\/ol>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">\u00a7 12. Final provisions<\/h2>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Matters not governed by these Terms and Conditions shall be subject to the provisions of Polish law, in particular the Civil Code, the Consumer Rights Act of 30 May 2014, the Copyright and Related Rights Act of 4 February 1994, and the Act on the Provision of Electronic Services of 18 July 2002.<\/li>\n\n\n\n<li>Disputes arising from contracts concluded under these Terms and Conditions shall be resolved by the competent common courts. In the case of a Consumer \u2014 the court having jurisdiction under the Code of Civil Procedure.<\/li>\n\n\n\n<li>The Shop reserves the right to amend the Terms and Conditions. Amendments shall take effect on the date of their publication on the Shop's website.
